Conditions of sale
The contractual conditions that govern the purchase of products and services through the website www.sanchotena.com, owned by María Eugenia Sanchotena Seziland (hereinafter, the provider or Sanchotena), are set out below. Acceptance of the conditions implies that the user has read, understands and comprehends what is set out herein; is a person with sufficient capacity to purchase, and assumes all the obligations set out herein.
These Conditions will have an indefinite period of validity and will be applicable to all purchases made through the provider's website.
Sanchotena reserves the right to unilaterally modify these Conditions, without affecting the goods or promotions that were acquired prior to the modification.
IDENTITY OF THE PARTIES
On the one hand, the provider of the goods contracted by the user is María Eugenia Sanchotena Seziland ( Sanchotena ), with registered office at Artekale, 8, Durango (Bizkaia) and email: info@sanchotena.com
And on the other hand, the user, registered on the website using a username and password, for which he/she has full responsibility for use and custody, being responsible for the veracity of the personal data provided to the provider.
OBJECT
These General Conditions of Sale are intended to regulate the contractual relationship of sale between the provider and the user at the time when the latter accepts the corresponding box during the online contracting process.
The contractual relationship of sale involves the delivery, in exchange for a price determined and publicly displayed through the website, of a specific product.
CONTRACTING PROCEDURE
In order to access the products and services offered by the provider, the user has the option of purchasing as a guest or registering through the website by creating a user account. To do so, the user must freely and voluntarily provide the personal data that will be required.
The user will select a username and password, agreeing to use them diligently and not to make them available to third parties, as well as to notify the provider of their loss or theft or of possible access by an unauthorized third party, so that the provider can proceed to immediately block them.
The user may not choose as a username words that are intended to confuse others by identifying him or her as a member of the provider, as well as expressions that are foul, insulting and, in general, contrary to the law or the requirements of morality and good customs.
Once the user account has been created, please be advised that in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:
-Summary (of the shopping cart).
-Registration (user authentication or account creation).
-Address (choice of delivery address).
-Shipping (choice of delivery method).
-Payment (choice of payment method).
-Confirmation (order completion).
The provider's purchasing platform will inform the user, once the purchasing procedure has been completed, via email about all the characteristics of the order.
PRICE AND VALIDITY PERIOD OF THE OFFER
The prices indicated for each item include Value Added Tax (VAT) or other taxes that may be applicable, and in all cases will be expressed in the Euro currency (€).
These prices, unless expressly stated otherwise, do not include shipping costs.
The prices applicable to each item will be those published on the website and automatically applied by the contracting process in its final phase.
The customer assumes that, in any case, the economic value of some of the articles may vary in real time. In any case, this will always be communicated to the user in advance.
The user may request that the provider receive an invoice for the purchase made; this service will not have any cost for the user.

In any case, the order number or reference that was assigned to you and indicated in the purchase confirmation email must be indicated in the subject of the message.
ORDER DELIVERY
Orders will be delivered to the shipping address freely designated by the user. Therefore, the provider assumes no responsibility if the delivery of the product does not take place as a result of the data provided by the user being false, inaccurate or incomplete, or when delivery cannot be made for reasons beyond the control of the transport company assigned for this purpose, such as the absence of the recipient.
Without prejudice to the foregoing, the provider will take the measures required of a diligent carrier so that delivery can be made within the agreed time, and if not, as soon as possible, to the satisfaction of both the sender and the recipient, for which reason no liability may be attributed to the provider.
In the event that an order is not collected by the user and the goods are returned to the provider, the return to the warehouse will incur transport costs that must be covered by the user. In this case, in the event of cancelling the order, the same conditions contemplated in the cancellation will apply. In the event that the user requests the reshipment of the order, the shipping costs will be paid again through the payment system provided by the provider.
Delivery of orders is subject to the announced availability of the items. Orders received will be processed (prepared and packaged) by the provider within the indicated period, excluding holidays (both national and local) and weekends.
The provider will supply unavailable items as soon as possible. If any of the products is not available within the announced time frame, the provider will contact the user, either by email or telephone, to inform them of the incident. If the delivery time is too long for the user, the provider will offer them a product that most closely matches their needs or will refund the corresponding amount.
All items from the provider leave the warehouse with their packaging in perfect condition. If the user observes external damage upon receiving the package, it is ESSENTIAL that they note this on the carrier's delivery note, indicating, for example, “VISUALLY DAMAGED PACKAGE”.
PAYMENT METHODS
-With credit or debit card.
The provider will not store any credit card data, as these are entered by the user through a secure payment gateway owned by the bank. The provider will only receive confirmation from said gateway that the payment has been made correctly in order to proceed with the shipment of the order.
Most credit and debit cards such as Visa, Visa Electron, Mastercard, Maestro, American Express, etc. are supported.
This payment method is immediate. Once payment has been made, the provider, after verifying the data, will begin to process the order.
This payment method has no additional costs.
Once payment and order have been made, changes to the delivery address are not permitted.
SHIPPING
Sanchotena ships orders to destinations in mainland Spain.
Delivery will take place within 3 to 5 working days.
If in any case the requested product is not in stock, the user will be notified by email. The order will be held until the product is available; at that time, shipping will be resumed under the conditions mentioned above. The user may cancel orders held for this reason if they so wish.
Shipping costs
The cost of shipping will be borne by the user and must be paid at the time of payment.
Our rates are as follows:
Spain €5.50.
Free shipping on orders over €90 in mainland Spain.
International Shipping:
Delivery 4 to 10 business days.
Austria, Belgium, Czech Republic, Denmark, France, Germany, Hungary, Ireland, Italy, Luxembourg, Netherlands, Poland, Portugal, Slovakia, Slovenia €15.00 .
Croatia, Latvia, Lithuania, Bulgaria, Finland, Romania, Sweden €30.00.
Greece, Malta €35.00.
No shipments will be made to PO boxes.
During periods of high commercial volume such as Christmas, holiday periods or promotions such as Black Friday, we cannot guarantee that the order will be delivered on time, since we cannot be held responsible for delays by transport companies on these dates.
WARRANTY
Sanchotena distributes its products in accordance with the highest standards of quality and safety. However, if you receive defective products, we will immediately refund the amount of the product and shipping costs.
RIGHT OF WITHDRAWAL
By law, every user has a right of withdrawal that allows them to cancel their orders within a period of no more than fourteen (14) calendar days, counted from the moment of receipt of the order, without the need for any justification.
If you wish to cancel your purchase, you must notify us by sending an email to: info@sanchotena.com. Sanchotena will reply by the same means, informing the user of the instructions to follow for returning the product.
Once the 14 calendar day period has ended, Sanchotena will not accept returns due to withdrawal from the purchase.
The product must be returned with a copy of the delivery note or invoice. The product must be in the same condition in which it was delivered and in its original packaging, otherwise the user will not be able to exercise the right of withdrawal. The cost of shipping will be borne by the buyer.
The return must be made within a maximum period of fourteen (14) calendar days from the moment in which Sanchotena sends you the return instructions.
The period for the payment of the amount paid for the product will be that established by law. The refund will be made through the same payment method used by the User at the time of purchase, unless the User agrees to a different payment method, in which case he/she must provide us with the necessary data to make the transfer.
APPLICABLE LAW AND JURISDICTION
These conditions shall be governed or interpreted in accordance with Spanish law in all matters not expressly stated. The provider and the user agree to submit any dispute that may arise from the provision of the products or services covered by these Conditions to the Courts and Tribunals stipulated by law.
In the event that the user resides outside of Spain, the provider and the user expressly waive any other forum, submitting to the Courts and Tribunals of the provider's domicile.
Pursuant to the provisions of Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes, applicable throughout the European Union, Sanchotena makes the following link available to users: https://ec.europa.eu/consumers/odr/ (European Platform for Online Dispute Resolution-ODR).
In the event of a problem with a purchase on this website, the user may use this means to file any claim they deem appropriate or to opt for an out-of-court settlement of the dispute.
